Shaquia Peace, Realtor® respects the intellectual property rights of creators, photographers, writers, videographers, brands, and all rights holders.

We strictly prohibit the unauthorized use of copyrighted materials on shaquiapeace.com (“Website”) and comply fully with the Digital Millennium Copyright Act (DMCA).

1. Submitting a Valid DMCA Takedown Notice

2. What Happens After We Receive Your Notice

Upon receiving a valid DMCA takedown request:

  • We will review the notice to ensure it meets legal requirements.
  • We will remove or disable access to the allegedly infringing material.
  • We may terminate or restrict access for repeat infringers.
  • We will notify the user who posted the content so they can respond.

We reserve the right to request additional information before removing content.

3. Counter-Notification Procedure (If Content Was Removed in Error)

If you believe that material removed due to a DMCA notice was removed wrongly or by mistake, you may file a counter-notification.

Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its prior location (URL).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as the result of a mistake or misidentification.
  4. Your full contact information.
  5. A statement consenting to the jurisdiction of:
    • The federal district court for your district of residence, or
    • If outside the U.S., the U.S. District Court for the District of Columbia.
  6. A statement agreeing to accept service of process from the original complainant.

If the counter-notice is complete and valid, we may reinstate the material according to DMCA procedures, unless the original complainant files a court action against you.

4. Repeat Infringer Policy

In accordance with the DMCA, we maintain a strict repeat-infringer policy.

Users who repeatedly upload infringing material may have:

  • Their access restricted
  • Their content removed
  • Their ability to post or submit content permanently disabled

We enforce this policy at our sole discretion.

5. Misrepresentation Consequences

Submitting a false DMCA notice or counter-notice can result in:

  • Legal liability
  • Financial damages
  • Court fees
  • Attorney fees
  • Civil penalties

Under 17 U.S.C. § 512(f), knowingly filing fraudulent claims is punishable by law.
